These Master Sweepstakes Terms & Conditions (“Master Rules”) govern all sweepstakes, giveaways, and similar promotions (each, a “Sweepstakes”) sponsored by YOWIE, a program of Doris Buffett Legacy Foundation (“Sponsor”), unless otherwise stated.

Each Sweepstakes may also have specific official rules or addendums (“Specific Rules”) that describe details unique to that Sweepstakes, including but not limited to entry methods, promotion dates, prizes, and eligibility requirements. In the event of a conflict between these Master Rules and any Specific Rules, the Specific Rules shall control. 

By participating in any Sweepstakes, entrants agree to be bound by these Master Rules and any applicable Specific Rules.

Eligibility

Must be 16 years or older to participate. Entries are void and this offer is not valid outside of the United States or where prohibited by law. All tickets, transactions, and winners are subject to federal law, state law, and all Sponsor rules and regulations. Entrants must possess a smartphone or other internet-connected mobile device capable of running internet speed tests. Sponsor employees, officers, and directors, their immediate family and individuals living in the same household are not eligible to win. 

Specific Rules will outline full eligibility per Sweepstakes. 

No Purchase Necessary

No purchase or payment of any kind is necessary to enter or win. A purchase will not increase chances of winning. 

General Entry Conditions

Each entrant may enter only as permitted by the applicable Specific Rules. Entries that are incomplete, corrupted, or submitted through unauthorized means are void.

Winner Selection, Notification & Odds

Winner selection details will be outlined on the Specific Rules for each Sweepstakes. The winner will be selected from all eligible entries submitted during the Entry Period using a random selection method via RandomPicker.com. Each valid entry completed and properly submitted during the Entry Period constitutes one (1) separate entry into the Sweepstakes. There are no limits on the number of entries per person, per household, or per day, but additional entries (speed tests) must be completed as outlined in the Specific Rules. Entries must include a valid email address.  It is the participant’s sole responsibility to ensure the Sponsor’s email domain (yowiepatrol.org) is whitelisted to successfully receive notification should they be randomly chosen as the winner.  Failure to respond to YOWIE Sweepstakes prize email notification within seven (7) calendar days of email notice of being selected will automatically forfeit the prize. If the prize is forfeited, an alternate winner(s) may be chosen. The winner must verify eligibility by providing proof of U.S. residency and a valid government-issued photo identification, complete and sign any required affidavits or releases, and comply with any other terms and conditions. The winner is solely responsible for all federal, state, and local taxes, fees, and other charges arising from the acceptance and use of the prize. Sponsor may issue a Form 1099-NEC or other tax documentation to the winner as required by applicable law. 

The winner's name and city/state of residence may be announced on YOWIE's social media channels and/or other media outlets. By entering, participants consent to the use of their name and likeness for publicity purposes without additional compensation or approval (except where prohibited by law).

The odds of winning depend on the total number of eligible entries received during the Entry Period.  No purchase necessary to enter and a purchase does not increase the chance to win.

Prizes (General Terms)

Prizes are non-transferable and no substitution is permitted except at Sponsor’s discretion. Sponsor reserves the right to substitute a prize of equal or greater value if a prize becomes unavailable. Winners are responsible for all applicable taxes, fees, and expenses not expressly stated.

Other Sweepstakes

By entering a Sweepstakes, you will not be automatically entered into or eligible to participate in or receive any prizes awarded in any other Sweepstakes. In order to enter multiple Sweepstakes, you must enter each Sweepstakes separately in accordance with the respective Specific Rules. 

Restrictions

By participating in Sponsor’s Sweepstakes, you agree not to reproduce, duplicate, copy, sell, trade, resell, or exploit for any personal or commercial purposes any portion, use of, or access to the Sweepstakes. You acknowledge and agree that the visual interfaces, graphics, design, compilation, information, data, products, services, and all other elements of the Sponsor’s Sweepstakes are protected by applicable intellectual property and other laws. Sponsor reserves all rights to each Sweepstakes not granted expressly in these terms and conditions.

Data and Privacy

By conducting speed tests using the YOWIE app, the following information may be collected: name (optional for speed test, but required for Sweepstakes entry); email address (optional for speed test, but required for Sweepstakes entry); geographic location: longitude and latitude coordinates; internet Service Provider (ISP) information; network technology type (4G, 5G, WiFi, etc.); upload and download speeds; timestamp of test. Sponsor will use the information collected to: administer and manage each Sweepstakes; contact the potential winner; conduct speed test data analysis and generate reports; improve the YOWIE app and services.  All personal information collected is subject to YOWIE's Privacy Policy, available at https://yowiepatrol.org/privacypolicy. By entering each Sweepstakes, you consent to the collection, use, and disclosure of your personal information as described in the Privacy Policy and these Master Rules.  

Email and Opt-Out

Sponsor may use email addresses provided during the Sweepstakes entry process to send updates about YOWIE, information about Sweepstakes results, and announcements about future Sweepstakes.  If you do not wish to receive future communications from Sponsor, you may unsubscribe by emailing Info@yowiepatrol.org with the subject line "UNSUBSCRIBE" or by clicking the unsubscribe link in any promotional email. Please allow up to 10 business days for your request to be processed.

Assumption of Risk

By entering this Sweepstakes, you assume all risks associated with conducting internet speed tests (including any injury or damage to your device), and use and enjoyment of the prize, including attending the event(if applicable). Sponsor is not responsible for any injury, loss, or damage to the participant, their property, or their device.

Limitation of Liability

You agree that Sponsor will not be liable for: lost, late, misdirected, incomplete, or illegible entries; technical failures of any kind (including app malfunction, internet outages, or server errors); unauthorized access to or alteration of entries; any direct, indirect, incidental, or consequential damages arising from participation in the Sweepstakes; any injury or damage to property or device; any claims arising from the acceptance, use, or enjoyment of the prize.

RELEASE AND INDEMNITY

By entering Sweepstakes, you release and hold harmless Sponsor, their respective officers, directors, employees, and agents from any and all claims, demands, or causes of action arising from your participation in the Sweepstakes or your use of the prize. You agree to indemnify and hold Sponsor and its affiliates, agents, employees, partners, and licensors harmless from any and all claims or demands, including court costs and attorneys’ fees, made by any third party due to or arising out of content you submit, post, transmit, modify, or otherwise make available through the Sweepstakes, your use of Yowie Internet Speed-Testing Sweepstakes, your connection to the Yowie Internet Speed-Testing Sweepstakes, your violation of the Rules, Terms and Conditions, or your violation of any rights of any third party.

Requests must be received within 30 days after the end of the Entry Period to receive a response.

Agreement:

Participation in Sweepstakes constitutes your full and unconditional agreement to these Master Rules, Terms and Conditions and to all decisions made by Sponsor, which shall be final and binding. Sponsor reserves the right to disqualify any entrant who:  violates these Master Rules, Terms and Condition; engages in fraudulent, dishonest, or deceptive conduct; fails to comply with the entry requirements; attempts to tamper with or interfere with the administration of the Sweepstakes; or harasses or threatens any Sponsor employee or representative. Sponsor reserves the right to cancel, suspend, or modify Sweepstakes at any time if it determines, in its sole discretion, that the Sweepstakes cannot be conducted as planned or if the integrity of the Sweepstakes is compromised. In such event, Sponsor may select a winner from all eligible entries received prior to cancellation using the random selection method described herein. Sweepstakes is not sponsored, endorsed, or administered by Apple Inc., Google LLC, or any other mobile device manufacturer. Participants acknowledge that this is a promotion by Sponsor and not associated with any device manufacturer or app store.
